iMuslim - Terms of Use

iMuslim Terms of Use are effective as of 1st September 2009.

Introduction
Welcome to www.iMuslim.co.za (hereafter "iMuslim" or "we"). iMuslim is primarily, but not exclusively, a listing tool for Muslim Businesses to advertise their services to the public. By accessing the iMuslim website you are agreeing to the following Terms of Use, which are set out to ensure that iMuslim works for everyone.

Listing on iMuslim
iMuslim is open to any Small, Medium or Large Muslim organisation, business or individual to list their business services. The listing period is set at either 6 or 12 months for business/service listings and adverts have a set display period of 3 months. You may at any time contact us to make changes to a listing you have made in order to update the information therein.

Within the last (1) month of a listing, before it has expired, you will be sent a notification of renewal by email (or SMS) to have your listing renewed. Listings that are not renewed before the listing period has expired will automatically be deleted from the website within the first month after expiry. Adverts will be removed as soon as the 3 month window has expired. All applications for listings are subject to the approval of the Web Administrator of iMuslim (hereafter "Administrator").

iMuslim also provides a Calendar service to Organisations for posting any charitable or fund-raising events. This service requires Organisations to register on the website and after approval by the Administrator, will receive a Username and Password. Using this, Organisations will be allowed to post as many events as they wish on the Calendar service provided the Administrator approves them. The Username and Password issued to Organisations on registration to use the Calendar service must be kept private. The registered Organisation is solely responsible for all posts made using this Username and may be held liable should any infringement arise.

Fees and Service
Registration and posting on the Calendar service is free to all Muslim Organisations and it offers an unlimited number of posts to the calendar. Listings of Mosques in the service directory are also free. Other listing and advertising will however incur a fee.
You will be able to review the costs and accept these Terms of Use before you finalise your listing. You are able to view the listing and advertising price list here. Any changes to our fees or fee policy will be made via the website and may not be sent by email (or SMS).
Our fees are non-refundable, and you are responsible for paying them once you have made a listing in order for it to go live (viewable to the public). Listings will only go live once the Administrator has cleared your payment.

General Terms or Use
As a condition of use of iMuslim you agree that you will not:

violate any laws of the Republic of South Africa
be false or misleading with regard to the information you post or list
post any obscene, defamatory or indecent material
infringe on any third-party right
distribute viruses or any other script that may harm iMuslim or the interests or property of iMuslim or it's users
use any robot spider, scraper or other automated means to access iMuslim and collect content for any purpose without our express written permission
disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in iMuslim.
harvest or collect information about others, including email addresses, without their consent or reproduce, copy, sell, resell, or exploit any content found on iMuslim.
bypass measures used to prevent or restrict access to iMuslim.

You are solely responsible for all information that you submit to iMuslim and any consequences that may result from your post. We reserve the right, at our discretion, to refuse or delete content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user's usage of the website either temporarily or permanently, or refuse a user's registration.

Information posted on iMuslim is publicly available. By listing or posting on iMuslim you are providing us with personal information and hence you are consenting to the transfer and storage of that information on our servers. We collect and store the following personal information:

addresses, physical contact information, and sometimes financial information
computer sign-on data, statistics on page views, traffic to and from iMuslim and ad data
other information, including users IP address and standard web log information.

We will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may however send you promotional material using the information you have supplied to us through your listings or posts.

Abusing iMuslim
We may issue warnings, remove content and take legal steps to keep users off iMuslim if we think that they are creating problems or breaching our Terms of Use Policy. However, whether we decide to take any of the above steps, we do not accept any liability for monitoring iMuslim or for any unauthorised or unlawful content on iMuslim or the use of iMuslim by users.

Liability
Although we preview users' listings, we are not involved in the actual transactions between users and thus do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what is offered. By using iMuslim you agree not to hold us responsible for the actions of other users, their posts or listings on the iMuslim website.
While we will use reasonable efforts to maintain an uninterrupted service we cannot guarantee this and we do not give any promises or warranties about the availability of our services or the servers it is hosted on.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of iMuslim, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Resolution of disputes
If a dispute arises between you and iMuslim, we strongly encourage you to first contact us directly to seek a resolution by going to iMuslim Contact Us page. We will consider requests to resolve the dispute through mediation, arbitration or other alternative dispute resolution procedures, as alternatives to litigation.

Finality
These terms posted on iMuslim constitute the entire agreement between iMuslim and you, superseding any prior agreements.
We may update this agreement via the website at any time. No other amendment to this agreement will be effective unless it is made in writing and signed by iMuslim and countersigned by the user.
